1. Introduction

On its website, HOTELERA SAN JORDI provides information related to the nature of its activities, as well as the products and services it provides. The website includes information about UNIVERSAL BEACH HOTELS brand hotels, operated directly by HOTELERA SAN JORDI or other companies, and users may request and formalise bookings directly online. By accessing and using this website, you agree to comply with the terms and conditions listed below, and are therefore advised to read this section carefully before starting.  HOTELERA SAN JORDI reserves the right to alter, modify, add or withdraw part of these conditions at any time and to make changes to the products and programmes included on this website without prior notice.  

2. User obligations

Users undertake to use this Website in a lawful manner, pursuant to the provisions of these terms and conditions and in a manner that will not damage the rights or interests of HOTELERA SAN JORDI or third parties. By way of examples, and in no case limiting or exclusive, Users also undertake the following:

- Not to attempt to access, alter, manipulate and, where appropriate, use other Users’ accounts;

3. Exclusion of liability.

This Website is provided "as is" and use thereof is at the User's own risk. Consequently, neither HOTELERA SAN JORDI, nor its administrators, employees, suppliers or collaborators shall be liable for damages of any nature, direct or otherwise, arising from the use of the Website. Speifically, HOTELERA SAN JORDI, is excluded to the fullest extent permitted by law of all kinds of warranties, both express and implied.

HOTELERA SAN JORDI does not guarantee the availability and accessibility of the Website, although it will make all reasonable efforts in this sense. Interruptions may occasionally occur during the time necessary to carry out the corresponding maintenance actions.  

HOTELERA SAN JORDI accepts no responsibility for any possible damage resulting from interferences, interruptions, computer viruses, telephone breakdowns or telephone disconnections caused by reasons beyond the control of the aforementioned entity; likewise, it is not responsible for delays or blockages in the use of this electronic system caused by deficiencies or overloads in the data processing centre, telephone lines, the Internet system or other electrical systems; or for any other alterations to Users’ hardware or software.  Nor does it guarantee the absence of viruses, malware, trojans or other elements that may cause alterations to Users’ computer systems, documents or files, and holds no liability whatsoever for damages of any kind Users may incur for these reasons. Furthermore, HOTELERA SAN JORDI shall not be liable for damages caused by third parties through unlawful interference beyond its control.

Likewise, it shall not be liable for damages caused by the use or misuse of the Website contents, or for any consequences arising from the errors, defects or omissions in the contents that may appear on this Website provided by the Users themselves or third parties.   HOTELERA SAN JORDI holds no obligations or liabilities whatsoever for the services it does not provide directly. 

4. External links.

Under no circumstances shall HOTELERA SAN JORDI accept any liability whatsoever for the contents of links corresponding to a third party website or for sections of the Website managed by third parties. Nor shall it guarantee the technical availability, quality, reliability, accuracy, extension, veracity, validity and legality of any materials or information contained on any of the aforementioned links or other Internet sites. Furthermore, the inclusion of these external connections shall not imply any form of association, merger or stake in the linked entities.   

5. Passwords.

The passwords to access Users’ accounts are personal, confidential and non-transferrable. Registered Users hold sole responsibility for maintaining the confidentiality and security of the account, and shall therefore exclusively assume all consequences of any type in relation to the activities carried out thereon. Users undertake to immediately notify HOTELERA SAN JORDI of any security breach of their account.

6. Access denial and account cancellation.

HOTELERA SAN JORDI reserves the right to deny access to the Website, as well as to suspend or cancel the accounts of those Users that fail to comply with these terms and conditions; in the event of unforeseen technical or security problems; inactivity of the account for a significant period of time; in order to comply with a summons and/or police, court or administrative order.  

Any such cancellations or suspensions shall be at the sole discretion of HOTELERA SAN JORDI and shall not imply entitlement to compensation of any form.

Without prejudice to the contents provided by the Users themselves or to which third parties hold intellectual rights, the intellectual property rights of the Website, the domain name, its source code, design and navigation structure and elements contained therein (including but not limited to images, sound, audio, video, software, or text; trademarks or logos, colour combinations, structure and design, etc.. ) are the property of HOTELERA SAN JORDI, which holds exclusive rights to exploit them in any manner, in particular the rights of reproduction, distribution, public communication and transformation, pursuant to the provisions of the Intellectual Property Law currently in force. It is strictly prohibited to reproduce, distribute and publicly communicate, including the availability mode, all or part of the contents of this Website in any medium and by any technical means, without the authorization of HOTELERA SAN JORDI or, where appropriate, of third parties who hold the intellectual property rights or copyright of the contents concerned. 11. Applicable law and jurisdiction.

Without prejudice to the consumer rights recognised by Spanish Legislative Royal Decree 1/2007 of 16th November, this website shall be regulated by Spanish law, with the exception of its rules of conflict of laws and all other disputes that may arise from its use or the services associated thereto, which shall be subject to the jurisdiction of the competent Courts and Tribunals, in accordance with the registered business address of   CIA HOTELERA SANT JORDI, S.A. In this sense, Users expressly waive any other jurisdiction to which they may be entitled.
